Facing the Legalities

When coping with the death of a loved one, there are many legal details that need to be sorted out. You may be wondering whether you need a lawyer. You may need to locate certain legal documents before the funeral arrangements are made. And what about the estate and the will? Let us help you clear up any confusion you may be feeling. If you have any questions or would prefer to speak to someone directly, please contact us.

Gathering the Important Documents
You may need to locate certain legal documents regarding the estate of a loved one, such as their will, life insurance or military service records. Our guide to gathering vital paperwork can help.
Will I Need a Lawyer?
Lawyers are society's professional problem solvers, and when you have estate issues to deal with, there’s no doubt an experienced attorney can help you navigate the legalities of dying. Here’s how.
Death Certificates
The death certificate, the permanent record of the fact of death, is perhaps the single most important document you’ll need in the coming weeks. Learn how we can help you obtain certified copies.
Notifying Creditors and Government Agencies
There are so many social connections you will need to notify of the death of your loved one. What should be your top priority? Follow our guidelines and 4-step notification process.
Social Security
A one-time payment of $255 can be paid to the surviving spouse if he or she was living with the deceased; or, if living apart, was receiving certain Social Security benefits on the deceased's record. If there is no surviving spouse, the payment is made to a child who is eligible for benefits on the deceased's record in the month of death.
For Veterans
The basic Military Funeral Honors (MFH) ceremony consists of the folding and presentation of the United States flag to the veterans' family and the playing of Taps. The ceremony is performed by a funeral honors detail consisting of at least two members of the Armed Forces.
